Article 1 Election of Officers

There is only one contested race, for the 2-year seat on the Planning Board.  All other positions have candidates equal to or less than the number of openings. You also have the option to write in the name of a candidate who has not declared they are running for an office.  You might want to ask them first, though!

Article 2 Clarify Flood Hazard Area re: Flood Insurance Rate Maps

Article 2 Flood Hazard Areas

What it means: This Article is meant to bring the Floodplain Development Regulation section of the town’s ordinance into compliance with the preliminary Flood Insurance Rate Maps (FIRM), allowing Hampton to remain eligible to participate in the National Flood Insurance Program once the new FIRM maps become effective in September.

Those in favor say: These changes are necessary for the town to maintain its eligibility to participate in the National Flood Insurance Program. Without the change, individual homeowners will not be able to purchase flood insurance.

Those against say: No one spoke against this Article at Deliberative Session.

Article 3 Change term “Special Permit” to “Wetlands Permit”

What it means: This Article changes the name “Special Permit” to “Wetlands Permit”. This permit has always been required for work in a Wetlands area, but the name is not as clear as it could be. The Article also clarifies some definitions, adds a definition of “vernal pools”, details the requirements for tree removal and replaces the word “impermeable” with the word “impervious” for consistency.

Those in favor say: We have for some time needed a better delineation of the wetlands, and Article 3 provides that.

Those against say: No one spoke against this Article at Deliberative Session.

Article 4: Dwelling Structure 12 feet from Wetlands

What it means: New housing construction in the RAA, RA, RB, RCS, G and I zones would need to leave the primary structure 12 feet from the Wetlands buffer so that buyers can enjoy and make good use of their outdoor space, without violating the town’s Wetland Ordinance. This article also combines sections 2.3.7C and 2.3.7Ca because the wording is almost identical.

Those in favor say: As the town becomes more developed, new construction is more frequently occurring on small, challenging lots. Often the house takes up so much of the allowable building envelope that there is no space for basic yard amenities. Increasing the space required around the perimeter of the home allows people who buy a new, free-standing homes to put in a shed, a deck, a patio, a lawn, or a swing set, etc.

Article 5: Clarification re: Dimensional Requirements in Town Center

What it means:

The intent of this article is to improve codification and consistency with the Dimensional Requirements table of the Zoning Ordinance. Codification allows each dimensional requirement in the table to be applied separately (preventing automatic zoning relief from the entire table). The Article includes additional requirements from the Dimensional Table that were not previously incorporated, along with Notes referencing how building height is measured and the applicable footnotes for sealed surface percentage exceptions.

Article 6: Off-Street Parking Towns Center District

What it means: The referenced ordinance relates to new construction (or expansion) of residential units in the Town Center District. If passed the Article would allow for exemptions from off-site parking requirements. It would allow developers to make alternate parking arrangements for the eventual buyers of the residential units. These arrangements would need to be approved by the Planning Board via a conditional permit. The Article would delete the distance requirement of parking to be a maximum of 500 feet from the proposed use.

Those in favor say: This is a “tweaking” of an Article that was passed last year. It is part of an attempt to create a “village” feel in the center of town, which was overwhelmingly supported by the Voters in 2014.

Those against say: People who buy residential units in town will need to park their cars overnight and it shouldn’t be in what are now “public” lots. By ordinance, the lots in the center of town have a limited number of hours that a car can remain. What happens when the business that has leased space for resident’s parking changes ownership? These questions were not answered at Deliberative Session.

Article 7: Permitted Uses in Towns Center

What it means: This Article seeks to strengthen the Planning Board’s oversight of non-residential uses in the Town Center District, allowing this recently established District to evolve into a special place for visitors can enjoy. If Article 7 passes, it will require a Use Change Approval for all changes of building occupancy involving any use of a non-residential nature. The new ordinance would designate prohibited uses for the Town Center-Historic District.

Those in favor say: This new oversight is necessary to put into action the Town Center District approved by the voters in 2014.

Those against say: No one spoke against this Article at Deliberative Session.

Article 8: Permitted Districts for Sales of Firearms and Ammunition

What it means: To establish separate Use Regulations for sales of firearms and ammunition. This use would be permitted throughout the Industrial District and also be permitted in the Business District, the General District, the Town Center-North District, and the Town Center- South District, but only on lots with frontage along Route 1.

Those in favor say: No one spoke in favor of the Article, except to explain its intention.

Those against say: The use of firearms is already regulated by the federal government and further restrictions are unnecessary.

Article 9: Permitted Signs in BS1 District

What it means: This Article clarifies that the existing Use Regulations and the existing Sign Regulations for the Business-Seasonal (BS) District also apply to the Business-Seasonal 1 (BS1) District.
